feel like it has been glossed over but the majority of these election lawsuits have been tossed out on procedural grounds (standing, laches, etc.) because they’re being submitted by over-their-head attorneys
the reason these over-their-head attorneys are even in the game is because the roster of very good and intelligent conservative attorneys are sitting this one out because, well, it’s just a political stunt and they want to continue to practice law after january 2020
but i think it’s important to note that in the majority of these big decisions, the opinions from the bench explain it’s being dismissed on procedural grounds but then also opining on the merits of the case itself
so i can certainly see a very near future where bad actors will try to say that the bench hid behind procedure so they didn’t have to address the merits, which they will claim were good and sound and they were just screwed by the deep state or whoever
but the merits are absurd, unfounded, and devoid of the kind of evidence you’d need to prove such extraordinary claims and most of the opinions made sure to address that as well.

and that goes for this texas lawsuit, too. it will be tossed for one reason or another but i highly doubt SCOTUS bothers to issue an opinion as to why. not really their style.

even if SCOTUS were to say “mail-in voting is unconstitutional” at some point down the line— they’re not going to toss out millions of votes cast in good-faith reliance that it was a proper way to vote. that’s the functional end of the republic, bro.
the only available relief would be for future elections. and that’s the second objective (first being to show trump’s base that you didn’t take 2020 lying down when you need their vote later). but i can’t stress enough that this election is over and has been for some time.
