Sovereignty is the antithesis of law. Understood as the brute power of an absolute monarch, it belongs to the world of nation states fighting for the sake of it, in an absence of international law.
It’s a concept that gave Europe a hundred years of war. The arrival of a rule-governed system then allowed us half a century of peace and prosperity. Destroying this is the real, undiscussed tragedy of Brexit.
The implications within the United Kingdom are just as stark. Absolute power transferred effortlessly from the Crown to Westminster, where it has remained. No promise, no undertaking given by the UK Parliament can ever bind a successor.
It doesn’t matter whether it’s written in a Statute, e.g. section one of the Scotland Act, or the front page of the Daily Record. It’s worthless!
