In September the #FBI liaison officer at the US Embassy in #Berlin delivered an unusual message to the German Ministry of Justice stating: We want to bring two German nationals to the US and put them on trial on terrorism charges.
The two men are currently held as #ISIS terrorist suspects in a Kurdish prison in Northern #Syria. One of them is Mohammed Haydar Zammar, a Syrian-born German national from #Hamburg and former close friend of the 9/11 attackers
According to our @WDRinvestigativ investigation the other person on America´s wish list is Yunus S., a 29-year old German-Turkish national from Bruehl (near Cologne) – who is suspected of having taken part in the attack on the US Consulate in #Benghazi in Sep 2012.
Last year Yunus S. gave an interview to the Kurdish news outlet Firatnews while imprisoned in N #Syria. He talked about his time in #Libya, stating he lived near Derna and was involved with Ansar al-Sharia.
He also talked about the attack on the US Consulate in Benghazi in which he allegedly took part alongside another terrorist fighter from Germany. Later in the news, he said, they heard a US diplomat was killed.
After Libya Yunus S. traveled to #Syria where he allegedly first joined Jabhat al-Nusra and later ISIS. He allegedly held various positions within #ISIS, operating in several cities among them Jarabulus, Deir ez-Zour and Mayadeen.
US intelligence allegedly indicates Yunus S. was a key facilitator for #ISIS, who operated a #Turkey-bases company involved in the procurement of drones worth over $ 500.000 for the terrorist group.
Now the US wants to put Yunus S. on trial – what is the German governments take on this? The German Ministry of Foreign Affairs pointed out that German General Federal Prosecutor is also investigating Yunus S. and that there is an arrest warrant for him.
Nevertheless the US request puts the German government in a dilemma: Germany´s General Federal Prosecutor is investigating Yunus S. for membership and support of a terrorist organization – not for his alleged involvement in the #Benghazi attack.
If convicted in Germany Yunus S. would likely receive a prison term of 4-6 years. But according to German courts: 1 year in a Kurdish detention center in #Syria is considered to be equivalent to up to 3 years in a German prison, this means he would be released very soon.
Apart from that German government is allegedly not able to extradite Yunus S. or any other German #ISIS suspect from the Kurdish prisons without the help of the US military.
A source explained: „We would need someone to bring him to #Turkey, #Iraq or #Jordan for us to bring him back to Germany. Only the US military can do that.“
What does all that mean? German government in fact is not able to prevent the US from coming after Yunus S. or Mohammed Zammar and putting them on trial in the US.
At least the US already ensured the Germans that the terrorist suspects would not receive the death sentenced if convinced – and would not end up in Guantánamo Bay.
