The challenge by the unsuccessful Mass. GOP candidates has an uphill climb before Judge Burroughs, who set a hearing for Dec. 17.

"There is nothing specific in your complaint that leads me to believe there is going to be any basis for granting a preliminary injunction on this."
Judge Burroughs: "What you don't get to do is look at an entire arrangement for voting … and not say a word until after you lose the election and then complain about the process."
More Judge Burroughs: "It's Dec. 8, the election happened over a month ago and you're asking me to invalidate an entire election."

She calls it "terribly unfair to all of the people who showed up to vote in the middle of pandemic to have their voices heard."
John Paul Moran, who lost to Seth Moulton, repeatedly says he is not an attorney. But Judge Burroughs explains they can't litigate the constitutional question via a preliminary injunction.

It would have to play out in the normal course (aka wouldn't help him win this election).
Moran & the others will get a hearing, Judge Burroughs explains the standard for a PI (similar to what happened in the Guliani hearing). But she's skeptical.

"You weren't complaining about [the election process] until you lost, I just don't have a lot of patience for that."
