Judge Batten immediately questions whether the Plaintiff’s claims should be brought to a State court instead of Federal court. Sidney argues that the claims are exclusively Federal under the Electors Clause.

Incredibly, Judge Batten is ignorant of the fact that that there is already a precedent for decertifying election results in Bush v. Gore. He clearly doesn’t have the balls to “turn back the clock and create a world in which the 2020 election results are not certified.”

Batten questions whether the case is moot, whether Trump can even win the election if he wins Georgia.

Sidney: “Fraud, Your Honor, cannot be allowed by a Federal court to stand.”

Batten argues jurisdiction: “Well that ‘rule of law’ limits where these suits can be filed and who can bring them.”

Sidney argues that the Equal Protection Clause gives this court federal jurisdiction. “This court is one of the primary checks and balances on the level of fraud we are experiencing here.”

Batten: “It doesn’t sound like your clients... have some unique status... that allows them to bring this suit instead of anyone else.”

Sidney: “They have the unique status of being the Presidential Electors selected to vote for Donald Trump at the Electoral College.”

“The fraud that has happened here has destroyed any public confidence that the will of the people is reflected in their vote and simply cannot stand.”

Batten returns with his verdict, grants the defendants’ motions to dismiss. Batten begins with the proposition of a limited jurisdiction that Federal courts “are not the legal equivalent to medical hospitals which have emergency rooms open 24/7 to all comers.”
