These attacks on “activist lawyers” are crass as well as damaging. If the government loses a case (following any appeal etc where relevant) it’s because it got the decision wrong. How can that be the “fault” of the lawyers bringing the case?
In fact the govt loses relatively few cases in the scheme of things. In no small measure, that is down to the diligence & professionalism of the govt’s own lawyers @GovernmentLegal who are of course just as “activist” in pursuing every proper argument & tactic in support of govt
Very occasionally we would encounter opposing lawyers who were not playing by the rules or were acting improperly - in which case we would absolutely take any proper points or steps against them. But that’s not the same as badmouthing your opponent just because they win.
One last thought. Any litigant (or indeed lawyer), including a Minister, is entitled to be disappointed when they lose a case. But again that doesn’t justify attacking your opponent for just doing their job.
