Today, US District Judge Garaufis ordered that the #DACA program be restored to its initial form. In his ruling, Garaufis reaffirmed his Nov. decision invalidating DHS’s July 2020 memorandum limiting the availability of the program. (1/7)

➡️ first-time applicants can apply now
➡️ #DACA recipients who were granted a 1 yr work authorization doc will have it automatically extended to 2 yrs

❗YES.

❓Can the government appeal the ruling?
❗DHS most likely will ask for a stay, to stop the order from being implemented, which could be granted soon. The issue could also be appealed to #SCOTUS before 1/20/2021.

❓How does this influence the Texas case?
❗Applicants in Texas should apply. US District Court Judge Andrew Hanen is scheduled to hear the Texas case, which challenges the legality of DACA, on 12/22/2020.

❓Can DHS issue another memo terminating the program?
❗No, they cannot. If they do, plaintiffs will ask Judge Garaufis to hold them in contempt. There is no action that the agency can take or gut #DACA until they have a Senate hearing to confirm Wolf.

❓Extension of work permit?
❗One-year #DACA grants and work permits will be treated as valid for two-years, this should not change even if they ask for a stay.
