First, the complaint in this case was filed by members of the Hindu Yuva Vahini, Yogi's old RW goonda gang.

But the ordinance says complaints of unlawful conversion can be filed by the aggrieved person or their family/relatives, not random persons (see Section 4 below).

Secondly, there was no conversion in this case as yet.

Therefore, not only does Section 3 (prohibition of unlawful conversion) not apply, there was no need, at this point, for permission to be taken from the DM, as the police are claiming.

Provisions for permission from DM apply to the conversion, not a marriage (see Sections 8 & 9).

In this case, Muslim man had agreed to Hindu rituals without yet converting. While this meant marriage registration may not have been possible yet, no impediment to the ceremony

While the law is blatantly unconstitutional, the provisions are being misused already jumbled around by police and thugs like HYV.

Sure, the wedding couldn't be registered, sure the later conversion of either would require DM permission.

If the conversion process wasn't later followed, then again, the marriage could be declared nullified.

But not yet. And also not on the complaint of unrelated goons from the Hindu Yuva Vahini.

The police handing out copies of the ordinance need to read it themselves.

But of course, this was the point and propose of this nonsense all along. They don't actually care about the law they have drafted, they just want another tool to harass interfaith couples and stop this from happening.

Note: in case anyone thinks section 6 of the UP ordinance applies to the Lucknow case - no it doesn't. There was neither a marriage purely for sake of conversion, or conversion purely for sake of marriage, taking place here. Without a conversion, ordinance is irrelevant.
