The DOJ has filed its Kevin Clinesmith sentencing memo

They want incarceration.

DOJ: Clinesmith wasn't just altering e-mails - he was lying about Carter Page in DMs to the FBI agent.

Thread.
Why the Clinesmith lie was material:

"It would raise the issue of whether [Carter Page] had those interactions with the intent to assist the US gov't."

It would go to the "loyalties" of Carter Page.

Clinesmith knew FISC needed to be informed.

@AWeissmann_ disagrees 🤦‍♂️
Clinesmith's lies "allowed the FBI to conduct surveillance" on @carterwpage thru a FISA application that "lacked probable cause"

He violated the duty of candor to the FISA court.
As to Clinesmith's excuses that he didn't think Carter Page was a source:

There is no evidence that anyone told Clinesmith that Page "was a subsource of a source."
As to Clinesmith's limited cooperation:

He spoke with the FBI Inspection Div. about "all FISA applications he worked on."

There is no broader conspiracy - looks like Clinesmith acted alone on this.

Sentencing is on December 10.
