Eastman lays out Article 2, Sec 1, and the plenary (exclusive) role of the state legislature in appointing electors.
Eastman notes that if the rules set out by the legislature for conducting elections are not followed by the state, the responsibility for choosing electors falls back to the state legislature.
As an example, in deviating from the standard for matching signatures on ballots, the state has violated the "approved manner of choosing electors," therefore, the legislature should reclaim its power to choose electors.

Eastman pointed out that in Florida, the legislature decided to take back the election when they believe the state had co-opted the process.
Senator points out that the Executive (Secretary of State) does not have the right to substantively change election policy or procedure that has not been approved by the legislature. Eastman agreed.
Eastman: The GA statute sets out a double-check for signature; both when filing an application AND when submitting the ballot.

The Secretary of State agreement modified the law to require only ONE signature check; either when the application is filed OR when the ballot is cast.
Eastman: Even if the state constitution prevents a special session of the legislature from being called, the constitutional requirement in Article 2 to choose electors supersedes state law or constitution.
Eastman argues that evidence presented in court (of fraud) is not required for the legislature to comply with its article 2 constitutional responsibility to choose electors.

Witness states he worked Fulton County recount: Saw large numbers of ballots that were not marked with a writing instrument. They were marked by a machine. Says he tried to bring attention to 9 red ballot bags without security tags and he was removed.
This morning's #Georgiahearing was abysmal. The afternoon hearing was well run and informational. Closing statements by Senators give hope that the Georgia legislature may have the courage to do the right thing.
