Most of us have seen the tweet about someone repackaging small chops and selling it off as her own and I've been asked if there are any legal implications. I decided to do a little research and this is what i found.
A 🧵
In my research i came across the term "reverse passing off".
Reverse passing off occurs when one producer buys another producer's product, removes the latter's trademark and replaces it with its own.
This is the opposite of the traditional trademark infringement act of "passing off." We are more familiar with the trade mark term, passing off.
For example:
Reverse Passing Off occurs when Risi pastries purchases divine pastries small chops, repackages it under their own name and sells it as their own as in the present case.
In this case, the public would come to associate the qualities of divine pastries Small chops with Risi pastries' and divine pastries' goodwill would become diluted over time.
This is probably the main issue with reverse passing off.
I'm not an IP Guru, that's @TheOladipo and @olanrewaju_tomi jurisdiction. I'm not sure it's covered under Nigerian trademark law. I'm yet to find a single nigerian article on it.

I've tried, go and do your own research.

Goodbye.
