Recommend @MayorKeller immediately (before December 4, 2020):
1. Identify, report and investigate uses of force and threats of force that are inconsistent with the City’s court-approved SOPs; (cont)
2. Take effective remedial and disciplinary actions when personnel do not comply with the requirements of APD Operating Procedures or, ipso facto, the CASA; and
3. Properly train and supervise its officers and front-line supervisors (cont)
"In the event that the City does not promulgate, and disseminate prior to the Court’s December 4,
2020 hearing, a sensible plan that is likely to swiftly accomplish those elementary steps, we will
ask the Court to: (cont)
a. enter a finding, based on the Twelfth IMR, that the City and the Albuquerque Police Officers Association are in civil contempt of Court, and
b. promptly schedule a hearing at which the parties and the amici can present to the Court recommendations for the further (cont)
remedial actions which the Court should take in order to
get this case on a course that can result in substantial compliance within a reasonable time. The remedy that seems to the McClendon subclass to be the most likely to achieve compliance with the consent decree (cont)
