There is a lot of talk of states not certifying their elections, which would change the outcome of the electoral college. So what happens if there is a “contingent” election and states do not certify their results and neither Trump nor Biden gets 270?
If enough states refuse to certify their results by the time the electoral college meets in December it could leave the US election in limbo. This could mean that Trump nor Biden reach 270 electoral votes.
If this is the case, the US House of Representatives would pick the President, while the US senate would choose the Vice President.
The House vote for president is not that cut and dry though, each state will vote together or as a group. Which means, all house members from the same state will come together as a delegation and vote. Each delegation only gets ONE vote.
The way the house votes in a contingent election is important, especially currently because Republicans control a majority of state delegations, meaning its most likely more states would vote for Trump than Biden, thus giving trump the win.
The senate would vote for the Vice President, this vote would be like a normal senate vote, each senator gets a vote. If Republicans win the senate, after the Georgia run off, then if it came to it, Mike Pence would be re-elected.
