The judgement by Nicol is not just straight out stupidity & unfair but it also sets such a bad precedent for future cases. Evidence like audios & conversation in it is not under oath, so it's not given weight. In the future, barristers can use this & will make case references 1/2
to prove their case. The appeal must be granted & JD must win this, not just for his own sake but to remove this miscarriage of a judgement. If the appeal upholds Nicol J's judgement, that's even more dangerous. 2/2
