Right now, the majority of the counties are in the process of recanvassing ballots and certifying their election results. Essentially, this means they are double checking that their math is correct and each candidate has received the true amount of votes 2/
While this is happening, the courts are deciding the fate of several things, most notably “challenged” ballots. These are votes that a campaign has an issue with for one reason or another. These are concurrent processes, meaning they are happening simultaneously 3/
There is also the possibility that “cured” ballots could trickle in. These are ballots where the BOE noticed a small mistake, informed the voter and gave them an opportunity. Most of these have already been returned, and Smith told me not to expect many more of these 4/
So all three of these things are happening right now, at the same time. However, what comes next will largely be up to the courts and what they decide 5/
Depending on the court ruling today in Oswego, the counties are expected to certify their results early next week. New York law says the counts have to be certified at the absolute latest by Nov. 28, so it’ll have to be done on or before then 6/
Up until now, all of the votes that have been reported are “unofficial”, because they haven’t been certified. Once the results have been certified, short of another court order, those will be the official and final tallies 7/
Once we have an official number of votes from each county, the candidate leading will be certified as the winner of the election. However, it very likely could still end up in a recount 8/
Right now, there is no statute under state law that would require an automatic recount. A law has been passed that takes effect in January, and any election after that within half a percent will be an automatic recount. At the moment though, a recount will be up to the courts 9/
So how do we get a recount? Smith says one of two ways: a judge could demand a recount personally, or a candidate could petition for a recount on the grounds of irregularities within the votes. If a recount is granted, the judge will decide how (hand count or machine) 10/
