Was talking to my therapist about how in lieu of the custody battle I’m hving + other stories I think a lot about the ineffectiveness of the judicial system.
Child services are carceral. Juvenile court and in turn domestic court is carceral. Everything is carceral.

It’s all designed to force you into respectability politics and struggle no matter the circumstances around the situation.

If on a socio cultural level we were more engaged in conflict resolution and valued autonomy/agency/accountability etc I do think transformative justice can be leveraged in lieu of carceral institutions.
There’s certainly things that need improving ofc.

But the justice systems carcerality revolves so much around property and money - if we gave every individual appropriate resources so much would shift and I imagine disputes would go differently with the removal of capitalism.

This whole process I’m going through is so unbelievably stressful on all parties including the child. We’re both struggling with debt, disorders of various kinds and reacting as such to preserve what we can. It’s endless.

For him, it’s money restraints, the ability to have a live in partner and visitation. For me it’s money restraints, relocation autonomy and keeping my daughter safe from any more incurred stress.

Because here I was after everything teying to balance fairness and what’s best for the kid and both lawyers had implicit biases working cause of the GAL.
So even tho he and I were at an understanding for each others wants, the lawyers instigated inflammation of the situation.

In the coparenting class we were mandated to take they tell you to emotionally divorce and allow room for both parents to grow and move. They promote harm reduction and transformative justice frameworks even tho they don’t say it.
But the court and lawyers abandon that.
