Just finished my last reading for my First Amendment class, and I’m here to say the Court’s Establishment Clause jurisprudence is thoroughly embarrassing.
The fact that Bill “the Dealer” Brennan is considered a hero or an intellectual titan by anyone is astonishing. The man routinely used phrases like “the secular celebration of Christmas” in his opinions.
The Jeffersonians & Calhoun were right about the federal courts. Hamilton was extremely short-sighted and is stupendously overrated.
Righties who are federal court junkies are exactly the kinds of people @michaeljknowles is talking about when he refers to court jester conservatism. Can’t play in the lefty kingdom and expect to win.
We don’t need an alternative to originalism like Vermeule proposes; we need to take power away from the federal courts.
