The real thing with the consent decree is SoS agreed to issue an “Official Election Bulletin” directing counties to conduct a more rigorous signature matching review/rejection process than is prescribed by law. 1/2
They might have an argument it was inappropriate, but I don’t think the argument an “Official Election Bulletin” materially changed actual law will hold up (seems it’s just official guidance). I’ll be interested to see what a judge does with it, though, as I’m no law expert. 2/2
