Someone called 911 at 10:40pm to report a dark SUV swerving all over the road, then hit a curb and was damaged. The officer arrived at 10:49. Even though he gave consent to a breathalyzer, he refused the blood test. By the time the court order came they drew his blood at 2:02am.
That means that the extremely reliable blood tests was administered no less than 3 1/2 hours after his last drink, and was still 0.095. From the phlebotomy report there’s no indication this was adjusted for the time factor. Going back in time to my Bassett Certification I’m...
Gonna estimate he had at least 5 drinks. And adjusting for metabolizing alcohol for 3+ hours, his bac was most likely .145 at the time of his accident. This isn’t a lapse in judgement. This is a problem that this team and it’s fanbase definitely doesn’t deserve.
