A Maricopa Cty judge this morning will weigh Trump/RNC claims that some AZ poll workers 'incorrectly rejected' votes cast in person on Election Day, possibly affecting final vote tallies. Here's a look at where the case stands heading into today's hearing: https://www.azcentral.com/story/news/politics/elections/2020/11/12/maricopa-county-judge-hear-trump-team-case-maricopa-county-votes/6260414002/
Haven't gotten into arguments yet because judge is reviewing some motions filed ahead of the hearing. One, filed on behalf of defendants, aims to exclude one of the plaintiffs' exhibits: voter declarations solicited online at http://donttouchthegreenbutton.com .
Trump atty acknowledges some declarations received through site were essentially 'spam'; those were removed. Others, he says, were cross-referenced to ensure voters were where they said they were on Election Day. Team also followed up w/ voters using the #s they submitted online.
Judge seems unconvinced of legitimacy of remaining online declarations. 'The fact that your process for obtaining these affidavits yielded affidavits that you yourself found to be false does not support a finding that this process generates reliable evidence. This is concerning.'
Trump attorney pushing back. 'These people were there, we know from county records. They're willing to take on criminal liability for misstating the truth to you.'
Judge grants motion to exclude declarations. 'If your process for gathering declarations has yielded statements, under oath, that your investigation has determined to be false, that doesn't give me any reason to believe your process is one that generates trustworthy affidavits.'
