1. #SCOTUS argument on Obamacare went pretty much as was expected: there’s a clear majority to uphold everything except the mandate. #CatoSCOTUS #CatoHealth
2. Chief Justice Roberts would prefer never to see this case—or any other existential challenge to Obamacare—again, and Justice Kavanaugh said in so many words that he considers the mandate to be severable from the rest of the law.
3. The new Justice Barrett is indeed the deciding vote, but only on standing, so it’s possible that the Court would dismiss the case on standing grounds without even reaching the merits.
4. But regardless, there’s no chance that the entire Affordable Care Act falls, so those who claimed that ACB threatened the health care of millions were either disingenuous or didn’t understand the case.
5. The Supreme Court should’ve invalidated Obamacare eight years ago, but what we have now is a different case -- @mfcannon calls it trolling John Roberts, which is funny and right, and deserved -- and the healthcare-reform ball is now squarely in Congress’s court.
