Tomorrow, a rather remarkable thing will happen:

A raft of extremely privileged lawyers, whose lives are not on the line, will hold forth, blessing us all with their opinions on the ACA case.

They'll share their absolute certitude that the Court will uphold the ACA.
They'll focus on standing & severability & the taxing power. They'll do so as an academic exercise, secure in the knowledge that their analysis simply must be correct.

Even more secure in never having really, truly grappled the consequences to those less secure than themselves.
I don't begrudge them their safety – after all, it is my most fervent wish that we realize healthcare as a human right.

I don't begrudge them their analysis – the odds may, even in 2020, favor their analysis.

But their arrogance? Their arrogance is insulting.
They'll do their cable news hits and NPR spots and they'll write their invited opinion pieces (these things, I've come to learn, are planned out well in advance) and then they'll go home. Unafraid.

Because they won't, any of them, be covered by Medicaid expansion.
It's a weird thing to be a health law expert who is covered by Medicaid.

I know, just as well as they do, that the Court should, the Court ought, to uphold the ACA.

But I also know that there have been far too many times that the Supreme Court has failed to do what is right.
And I am acquainted with the potential consequences of the Court (a Supreme Court that Trump & McConnell have remade) harming the ACA.

I do not believe it is possible to have that sort of understanding of the consequences and hold the arrogance that they display at the same time
This is my confession: I didn't pitch any pieces or seek out any press conferences for "ACA day" (as it's being called in my inbox) because I couldn't stomach the thought of their disdain for a lawyer covered by Medicaid.

And I wanted to be here, instead, with you.
(To my lawyer friends, I do not mean you. You are never who I mean in these things, because, quite simply, we never would have become friends if you were the people I do mean.)
