Last week, the SCOTUS for the second time denied the GOP request to review the PA Supreme Court order extending the received-by deadline. 3 Justices who thought the GOP case had merit said okay, but come back later if you want, and meanwhile, keep those ballots separate.
That's what the Secy told the county officials to do. The latest filing (link below) by the GOP said they weren't sure whether county officials were complying with the Secy's guidance, so Justice Alito, please tell them they must do so. https://www.scotusblog.com/wp-content/uploads/2020/11/20A84.pdf
But that's not all. The GOP applicants also said that county officials shouldn't COUNT those late-arriving ballots, even if doing so separately, because if those ballots are later held invalid, it will undermine the election's integrity. They asked J. Alito to stop the counting.
Here's the thing though. Justice Alito's order tells the county officials to segregate the ballots (which they had already been told to do by the Sec'y) but Alito's order does not tell them don't count the late ballots.
On the contrary, it says that if you do count them, do so separately--which again, is what the Sec'y had already told them to do.
This likely doesn't matter because there aren't enough of these late-arriving ballots to change the outcome, but the great irony is that with Biden now leading, if there are a lot of late-arriving ballots, Trump would be the one who would benefit from counting them.
So Justice Alito denied the GOP what it was seeking, but what it was seeking was an order that would close off one of its few remaining paths to even a prayer of victory. I believe that's what the kids call a "self-own." /End of Thread
