Plenty right now is troubling. But legally? So far, nothing there. To actually WIN a lawsuit, you need (1) a legal claim; (2) to prove up facts with evidence; and (3) a remedy that both matches your claim and gives you meaningful relief. Let's go through some of Trump's  1/
Fraud claims in Nevada?  Among the reasons this is not worth our time-- no evidence to support this claim. It has a Category 2 failure (need to prove facts with evidence), among other problems. 2/
Lawsuit re: a small number of PA absentee ballots that might not be fixed until next week? Among the reasons this is not worth our time -- the remedy is not likely to make a difference in the outcome. Category 3 failure (not an impactful remedy), among other problems 3/
Broadly alleging that an election is being "stolen"? Among the reasons this is not worth our time -- an allegation is not a legal claim. Category 1 failure (must be formulated as a legal claim), among other problems. 4/
Lawsuit vaguely alleging improper counting in GA?  Among the reasons this is not worth our time - no evidence to support this claim. Category 2 failure (need to provide facts with evidence), among other problems. 5/
Ranting about fraud at a press conference?  Among the reasons this is not worth our time-- ranting is not a legal claim. Category 1 failure (must be formulated as a legal claim), among other problems. 6/
Arguments re: a small number of PA ballots, pending in SCOTUS?  Among the reasons this is not worth our time -- the remedy almost certainly will not make a difference in the outcome. Category 3 failure (not an impactful remedy), among other problems. 7/
Lawsuit in PA re: where observers are placed? Among the reasons this is not worth our time -- the remedy doesn't change the counts at all. Category 3 failure (not an impactful remedy), among other problems. 8/
"IF YOU COUNT THE LEGAL VOTES, I EASILY WIN THE ELECTION"? Among the reasons this is not worth our time-- an all-caps tweet is not a legal claim. Category 1 failure (must be formulated as a legal claim), among other problems. 9/
Lawsuit in MI re: where observers are placed? Among the reasons this is not worth our time -- the remedy doesn't change the counts at all. Category 3 failure (not an impactful remedy), among other problems. 10/
Lawsuit re: a small number of PA absentee ballots that might be fixed next week? Among the reasons this is not worth our time -- the remedy is not likely to make a difference in the outcome. Category 3 failure (not an impactful remedy), among other problems. 11/
Did I miss any? Sure did! These "legal" arguments keep coming. But I'm pretty sure the three-category framework above helps to explain, for every single one of these allegations, why none has introduced a meaningful legal issue into the election at this point. 12/12
