Here are some things the executive branch can do related to transportation without needing approval from Congress:
- Purchase all-electric vehicular fleets for all federal agencies
- Allocate discretionary DOT grants exclusively to projects designed to combat the climate crisis
- Change rules related to MPOs; require them to have democratic voting structures
- Alter CMAQ requirements so road expansions don't count as "pollution-reducing"
- Mandate minimum service levels for all transit projects, like light rail & bus rapid transit, receiving grants
- Increase the use of Clean Air Act requirements to push states to stop investing in new roads (at least until the Supreme Court gets rid of the Act)
- Increase information about the availability of pre-tax transit benefits so commuters know about it and push their employers
- Mandate that CDBG and LIHTC funds are associated with projects that include access to effective transit & bike options
- Stop placing new federal facilities in sprawling areas; concentrate new federal investments in infill locations throughout the country
- Allow more communities (like New York City, for example) to implement congestion charging without delaying them for years
- Reduce the administrative burden for new climate-friendly projects, while increasing it for road expansion
There's a lot a new administration could do, even without Congressional control!
