As far as I know there are two conservative lawyers w/ media platforms who have successfully argued complex litigation matters before federal circuit courts, worked at DOJ or White House Counsel office and who have written extensively on Con Law subjects: @marklevinshow and me. 1
That doesn’t mean we are correct on any specific argument, but it means that our assertions about the difference between allegations, evidence and verdicts are based on actual experience, and our cautions come from decades of advising real clients, not Green Room lawyering. 2
Neither of us has made any irresponsible claim or assertion and both of us caution against indulging conspiracy theories but also caution legacy media that 70 million @realDonaldTrump voters are weighing choices by all media and are figuring out their media consumption diets. 3
Insulting 70 million viewers and their purchasing power is an extraordinary level of indifference that can only be indulged if a platform decides to limit its reach to hyper-partisans. Brand damage is enduring. Some platforms are making good choices. Others terrible ones. 4
The country would be better served if those 70 million voters get honest, thorough and precise acknowledgment of their concerns by all platforms. Certainly Georgia’s electorate and future electorates are weighing the ongoing coverage as they make plans. 5
