In Negusie, Barr overrules the BIA, stating that there’s no duress exception at all to the persecutor bar to asylum. So if a tortured prisoner or child soldier assisted in the persecution of others, even if they did so under threat of death or after being tortured, that’s too bad
The previous precedent decision wasn’t perfect but provided just a little recognition of painful realities that victims of persecution & torture often have to navigate. Imagine deciding you need to make it clear that child soldiers will never qualify for asylum— no exceptions. 😡
Just another indication of what we can expect from the DOJ and AG Barr if Trump wins this election.
