I'm not a Democrat partisan, but I am a lawyer. And I have a very good idea of where these election lawsuits are going: nowhere. Full disclosure: I'm a never-Trumper from way back. But I've been involved in electoral politics since I was a teenager.
I've been involved in one of Mississippi's most hotly contested election lawsuits, Ware v. Dupree, mostly because the Ware team's war room was in my office landlord's conference room. Election contests are very heavily based in state law; this is true even for federal elections.
This is because the several states determine who the electorate is, how they vote, and how those votes are counted. We have some federal overlap because of the HAVAct, but those are more in the nature of guidelines for equipment and verification standards.
Each state determines how poll watchers are certified, how many are permitted per polling place, etc. States determine how far away from a polling place you can electioneer. States have a lot of control over the process.
That's why there are different claims for election lawsuits in different states. That's why different states have different procedures for contesting votes and verifying votes. That's why we have different dates for certifying results.
State procedures are good at catching obvious frauds generally, such as ballot box stuffing, double voting, switching ballots, and ballot dumping. They are also good at catching corrupt officials. Almost all ballot fraud is detected. Much more significant is error.
Human error is the number one cause of voting errors. Fraud is a very tiny contributor to voting errors. For that matter, internet hacking of votes is essentially non-existent. But human error is common, and problematic, and the more complex the systems become, the more error.
What we need is better ballot design, pen and paper voting, and electronic verification of ballots.
