2/ Judge Hanen was quick to add: “If I were voting tomorrow . . . I would not vote in a drive-through just out of my concern as to whether that’s legal or not"--and he underscored that the very conservative 5th Cir might overrule him.
3/ Given that uncertainty and the risk that ballots cast in the AM could be disqualified by the 5th Circuit later in the day, the Harris County clerk kept only one drive-through voting locale, effectively mooting the case.
4. It is true the 5th Circuit then dismissed, but that's not really a victory so much as confirmation that Harris County conceded, out of an again understandable abundance of caution.
5 the article mentions all this, but we're all consuming so much news in such short amounts of time that I fear the headline--& others like it on my TL--are failing to capture that this is anything but a vindication of the right to vote or evidence of a well-functioning judiciary
