with the filing extensions ordered by the Military Judge due to the COVID 19 pandemic, a January start date is unlikely. Currently, filing requests have been extended 180 days past the scheduled January trial date, which indicates that member selection would not begin before the
summer of 2021.” + “Amendments to the scheduling order indicate that COVID-19 circumstances have impacted the Commission schedule. Trial scheduling orders may be matters subject to litigation in the commission.  Because matters subject to litigation are committed to the presiding
military judge to decide, it would be inappropriate for the Department of Defense to comment on matters in on-going or pending litigation.  It is undisputed that these are very complex cases.  However, the goal of the United States has been to afford fairness in reaching just
outcomes to these cases.  Beyond that, the Department of Defense cannot speculate on matters related to the Commissions’ timeline.”
