The 1950 Presidential Order discriminates on the lines of religion & denies reservation benefits to the Muslim & Christian Dalits.
The Committee (Ragnath misra)which submitted it report in May 2007, recommended that SC status be separated from religion but it was not implemented
It’s like killing of two birds with one stone. It’s an irony that the very constitution debars Muslims from being included in the category of SC ,Then Seats are reserved for SC in legislative bodies–but it is done in effect by diminishing the Muslim rep in the very legislatures
Number of Parliamentary & Assembly constituencies with substantial Muslim voter population often more than 50% as well are reserved for SCs while the SC pop was not high there.

By this move, it was argued that Muslims are being systematically denied political participation.
The charge of some design against Muslims gets stronger when one finds a number of Seats with comparatively lesser Muslim voter population remain unreserved even though they have sizeable SC pop often closer to one half.

The issue was highlighted by the Sachar Committee
Analysis relating to the reserved seats for the SC in three states of UP, Bihar & W Bengal suggests that there is truth in the allegation,The Sachar Committee had recommended a more rational delimitation procedure that doesn't reserve seats with high minority pop shares for SCs
will improve the opp for the minorities, esp Muslims, to contest & get elected, Apart from these 2 initiatives it is imp to evolve other methods to enhance political participation of the Community, the Committee had recm but it seems no step has been taken in this regard so far.
The Section 9 (1) (c) of the Delimitation Act mandates that those seats shall be reserved for SC where their %ge is highest in state. However, this law has been violated.This is injustice to SCs as well as their larger pop remain unrepresented & don't benefit from the MPLAD funds

Matter had been adequately flagged by Justice Sachar Committee but detailed study was left to be done by the Delimitation Commission to whom this issue was never referred by govt.
Muslims are lagging behind everybody else, including the SCs, in social, eco & educational fields
The prime reason stated was their thorough underrepresentation in the country’s governance.
