JUST IN: Adviser appointed by Judge Sullivan in FLYNN case urges him to deny DOJ's motion to dismiss the case, calling its decision a clear pretext for Trump's pressure campaign. Flynn's guilt is "obvious" he argues.
The adviser, John GLEESON, argues that Flynn's lies were obviously "material" to the FBI's ability to protect national security and that DOJ's determination they were not "material" conflicts with its handling of other cases — and its prosecutors' arguments earlier in the case.
GLEESON also argues that DOJ is asking the court to put its imprimatur on an obviously "corrupt, politically motivated favor" for an ally of the president.
GLEESON homes in on another key point: That Flynn claims he was pressured by prosecutors to plead guilty while DOJ still maintains there is no evidence of prosecutorial misconduct.
NEW: In an unsparing, 30-page attack on the Justice Department's decision to drop charges against Flynn, a court-appointed adviser makes the case that Judge SULLIVAN should reject the move and sentence Flynn instead. w/ @joshgerstein https://www.politico.com/news/2020/09/11/court-corrupt-doj-drop-michael-flynn-case-412555
