Back at the Sharmarke Ali trial. The former rookie Ottawa Police Officer is testifying today. He’s accused of sexually assaulting a then 18yo woman last April
Ali says the woman initiated their first case on Rideau St. He says he didn’t see signs that she was intoxicated. He says she seemed upset when they met. He pulled over to talk to her. As he said in police interrogation- “she was pretty”
On the interaction in the street - Defense @mspratt asks if complainant showed any sign “that she wasn’t into what was going on”
Ali: “Not at all”
Ali is asked to describe their interaction when he pulls into her apart building’s parking lot:
“There’s tongue. We’re touching each other she’s trying to get on top of me”
Ali: She undoes my pants and has her hand on my penis
D:Did you do anything to put her hand there?
Ali: no
D: Did you touch her chest?
Ali: Possibly because she was wearing a strappy top- but “I didn’t touch her boob”
I got the sense in my mind that she wanted to escalate. She was on top of me, undid my pants. I’m not saying I didn’t want to escalate but didn’t want to do it in car
Ali says he did ask for one more kiss. Then she said she has to go because her roommate was coming back soon. Says he got out of the car to adjust his pants, because he wears his pants low. He was looking in his car for his cell phone. When he looks up she's at the door
Ali says she kisses him again and says :Take me on a date next time.
Ali says I get in the car and does a U Turn out of the parking lot and drives off on Rideau St.
Says he didn't follow up with her to arrange a date.
Ali says he would have been okay with "having a hook up" in her room. I was physically attracted to her, she's very beautiful, but didn't want to make an effort to follow up and ask for a date, given the "drama with her ex"
When he met the woman on Rideau St, she told him that she was crying because her ex was dancing with another girl
Defense is now taking us back to the day, Ali was arrested. He had just completed his shift, asked by his Sgt to go into a room. Two Ottawa Police officers in a room were waiting for him.
Ali says he had no idea what they were there for.
Ali: When I was initially confronted, the detective (Allison Cookson) wouldn't tell me what happened. He didn't know what he was being accused of, until they arrived at 19 Fairmont. Ali was working at the West Division Station in Kanata on Huntmar Rd.
Defense: Why were you talking to them and giving police information?
(he did an interview for more than an hour without a lawyer)
Ali: Eventhough they offered to give me a lawyer, I was adamant that nothing happened. I was really trying to plead to the detective
Ali says on the stand..he's raising his voice because he's angry when he looks back at that police interview. Because he realizes the detective (Carolyn Botting) didn't care about him. Says he's incredulous that there is zero camera footage collected on Rideau St.
