(1/5) Did the Secretary for Justice actually write this oped? If so, perhaps she should explain to HK's next Chief Justice why she misquoted him in support of her anti-separation of powers agenda? https://www.scmp.com/comment/opinion/article/3100695/why-separation-powers-has-no-place-hong-kongs-political-structure
(2/5) Oped implies soon-to-be Chief Justice Cheung expressed doubts on sep. of powers in a 2008 judgment & advised "great care in its application in HK". But has the author ever read that judgment? If so, she'd know the judge actually said sep. of powers is "enshrined in the BL".
(3/5) Oped misquotes a section which cited Mason (a strong advocate of sep. of powers) as making the different (and common-sense) point that what we need to be careful about is indiscriminately applying foreign judgments on sep. of powers, as exact way doctrine applies can vary.
(4/5) Also many other distortions. Executive-led govt has only ever been mentioned by courts in 2 cases since 1997, compared with more than 70 cases which have referenced sep. of powers. But you wouldn't get that impression from reading this oped.
(5/5) Strangest of all is (brief) reference in this oped to People's Congress system in China. Surely first time this has been mentioned in article by a HK official? Did SJ really write this herself? Or was it penned by someone more familiar with the People's Congress system?
