11. When Supreme Court illegally took cognisance of alleged contempt & decided to hear the matter against a Constitutional functionary, a sitting High Court, it failed the Constitutional machinery.

.. the Constitutional machinery, the High Court Judge left with no option but to pass certain orders restraining Supreme Court 7 Judges. Under the existing circumstances, the orders passed by Justice Karnan were neither illegal nor bad. He passed those orders out of compulsion..
13. How Supreme Court committed grave & unpardonable wrong:

1. It failed the constitutional machinery.

2. It deprived the Parliament from its exclusive power vested by Article 217 proviso (b).

3. It deprived the tenure of office to a High Court as guaranteed by Article 217(1).
.. 4. By sentencing Justice Karnan, the Supreme Court violated the Basic Structure of Constitution, i.e. independence of judiciary. By sentencing a Judge, it undermined the fearless character & independence of High Courts. Remember, High Courts are not subordinate to Sup Court.
.. 5. By trying a contempt of court case against a High Court & sentencing him for six months, the Supreme Court created the Constitutional crisis unprecedented in the Histrory. It was a grave act of misuse of Jurisdiction by Supreme Court.

in connection with any pending case nor was there any prohibitory order by Supreme Court.

Justice Karnan was ridiculed, condemned & let down by the system or by the influential class because he was not a Brahmin/upper caste man & he was from the OBC/SC/ST communities.
