the adjustment of investigative rights between the prosecution - police in sf2 and why it’s become a key issue

in sf2, police side wants more freedom in investigation meanwhile prosecution side wants to protect their power to control police investigation.

currently in korea, this issue has been around for years regarding the investigative rights from specific institutions.
the prosecution in korea has the exclusive rights to indict and seek warrants for suspects, has broad judicial control over the police, and has the ability to close investigations.
police are able to initiate probes but not allowed to close them without prosecution approval. only prosecutors can file indictments in direct control of police investigation.

sf2 example: tongyeong drowning case.
the concentration of power has raised concerns: the prosecution may abuse its investigative power in favor of those in power and violate human rights.

the prosecution also has been criticized by public for holding too much power by monopolizing the right to indict suspects.
to limit prosecution’s power, the reform plan has been promoted consistently since president moon jae-in took office in 2017.

this was one of moon’s campaign pledges and was at the center of the president’s campaign to root out social injustice.

one of the bills in the reform proposal is the expanding of police autonomy, allowing the police to open and close cases without approval from the prosecution.

(this is interesting and i wonder if sf2 will brings this point or not)
and according to the reform plan, the relationship between the prosecution and police will be changed from a command structure to "investigation cooperative."
if opinions differ over important investigation procedures, prior consultation will be mandatory, and regular investigation councils will be held between the supreme prosecutors' office and the national police agency.
