Labour Law argues from the basis of equity (not equality) & that discrimination is fair if it is for purpose of redress. Constitution calls for redress

E.g. if men are earning higher for women in same job it wld be fair for Co to give women a larger annual increase to close gap
What is infrequently examined in these exchanges is the consequence of doing nothing.

By doing nothing society perpetuates the status quo.

By arguing do away with BBBEE/EEA becoz it uses race then in effect ur for the status quo.

Unless ur proposing an alternative.
What is the status quo?

StatsSA data is clear, by every societal measure whites were significantly better off in 1994 (poverty, unemployment, senior management, housing, services, graduate jobs) & in 2020 are still better off...

But the gap is getting smaller in some areas.
The other point oft missed is that EEA is impacted by those ALREADY employed vs those SEEKING employment.

The young white guy turned down for a job application is oft becoz there’s already enuf white males IN the Co.
Undoubtedly current status quo favours whites & males. As it did in 1994.

Had Gov not intervened in 1998-2001 with Employment Equity would Business have changed by itself?

Trends & org studies suggest very little.

For SA not changing the status quo is untenable.
So how best to do redress?

Both EEA & BBBEE are best practice designs from across the world. They’ve been carefully thought out

But theory & practice differ.

Doing redress in a growing economy is a different prospect than in a declining/job-shedding economy. SA has the latter
Government corruption & incompetence also detracts from the ability to implement BBBEE/EEA effectively

But it doesn’t negate the principle of redress.

Therein the key: vision, strategy, structure & implementation all need to be aligned & working for any Gov action to succeed
Choosing to do nothing (or undoing the current initiatives) perpetuates the status quo.

So something must be done...

And a means-test as alternative isn’t the answer (but that’s for another thread)
PS I often wonder why those vehemently opposed to BBBEE/EEA do so on the basis of race being the great evil but seem less vocal on issue of gender & disability?
