This argument on minimum age of marriage is bunkum for following reasons
- Given nature of Indian State and populace, this can only be enforced on marginalized groups. Even then, mainly as a tool of harassment by the Indian State.
- Like with child worker, truancy rules RoL /1
will utilize this as an opportunity to put women of vulnerable groups into women's shelters under guise of rescuing them from underage marriages. Said women's shelter are already run by RoL and agencies that intervene in such marriages are already controlled by RoL. So don't /2
come at me with ignorant takes on how Hindu organizations can also do the same.
- Personal laws of RoP are anyway out of bounds for the Indian State, since they are covered by separate civil code which effectively refers to sharia law only.
- The only groups that will abide /3
by this law strictly are those Hindus/Christians/Sikhs and Jains that need their marriage registered.
In all these groups age of marriage is anyway rising. Later the age of marriage, later the age of first childbirth and lower the possibility of a second child. Raising the /4
age of marriage will only accelerate this trend and accelerate the TFR reduction among those Hindu groups that have managed to keep the demographic balance somewhat.
Now, you will come at me with a scenario when age of marriage is increased after a UCC is passed.
First, even /5
if UCC is passed, given how we shepherd legislation through, it wi be passed with special caveats for RoP. Age of marriage will be one such dispensation that RoP will get.
Finally, best of luck making the RoP hordes follow the law. Heck, you can't fine them for not wearing/6
helmets or get them to immunize their kids. And you want to step into their drawing rooms and bedrooms.
What strikes me is how freedom-loving people are okay with such a direct intervention of the State in personal lives. Age of consent = age of voting = age of drinking = /7
age of driving = age of marriage. If the state determines that an individual has sufficient agency to know whom to sleep with, that's sufficient agency to marry, drink, drive and vote. Rest all stories about spending a year to find yourself and another to play with what you /8
find may be filed under @HonduHotTakes
Jai Hind. /END
I have no interest in policing others' views ji. I just say what I think. To the BJP, I'm an ordinary citizen with no skin in the electoral game, so they will not take me seriously. They will react if I bring up governance issues that affect me directly since I'm a consituency /1
