2/ A federal court has ruled that importing inputs from China/India and making the final drug product here makes it "USA made". Happily, the EO includes "critical inputs" (active ingredients and key starting materials used to produce final drugs) for targeted procurement.
3/ Another problem I wondered about was the WTO Govt Procurement Agmt (WTO GPA) which requires us to treat 45+ countries' goods as domestic. Drugs made in Ireland are deemed US made. The EO solution: directing USTR to exclude pharma from our GPA commitments.
