On Saturday, July 25th, at 9:52 pm, Garrett Foster was brutally murdered at the corner of 4th and Congress. A longtime advocate for BLM, human rights, and police reform, Garrett was exercising his constitutionally-guaranteed first amendment right to protest when a motorist drove
into the crowd, rolled down his windshield, and fired 5 shots. Three out of those 5 shots hit Garrett. The murderer quickly sped away from the crime, leaving Garrett to die there on the street. As many of us tearfully looked on, Garrett succumbed to his injuries. Our hearts will
forever go out to Garrett’s family, his fiance Whitney, and all those affected by this heinous act of violent terrorism.

In recent days, Garrett’s murderer has been exposed to the public. Thanks to the work of independent investigators, including reporters from
Tribune of the People, the murderer Daniel Scott Perry has been outed and we’re now able to place a face with a name. Facing public scrutiny and outrage, his lawyers have put out a grossly misleading statement in an effort to get ahead of the story. DO NOT be fooled by their
mischaracterization of the events. The author of this statement, like many of us, was there when it happened. DANIEL SCOTT PERRY MURDERED GARRETT FOSTER IN COLD BLOOD. A close look at the victim, the perpetrator, and the events of that night make this plain to see.
In an effort to set the record straight, the following points should be made whenever possible:

-GARRET FOSTER was an Air Force veteran who honorably served his country.
-GARRETT, along with his fiance Whitney, VOLUNTEERED TO FEED THE HOMELESS EVERY WEEK
>He continued to serve the community even after his military service ended.
-GARRETT WAS A FAITHFUL AND DEVOTED PARTNER, having been with Whitney for 11 years.
-GARRETT had attended numerous protests WITHOUT his rifle before the night of July 25th.
>GARRETT had witnessed brutal attacks on the protesters before, both by law enforcement and by crazed white supremacist terrorists. HE DECIDED TO PROTECT HIMSELF, WHITNEY, AND THE COMMUNITY.
>GARRETT was witness to the car attack on protesters on June 27th, and saw that
the Austin Police released the armed perpetrator without charges. He stepped up to do the moral, brave thing when he saw that APD wouldn’t.
-DANIEL SCOTT PERRY is an Army sergeant stationed at Fort Hood, a base that has a recent history of violence perpetrated by its own soldiers.
>PERRY has made numerous violent threats toward protesters on social media.
>PERRY has a history of violence. In 2005, he was charged and convicted of assault.
>PERRY has absolutely no remorse for his actions. HE RETURNED TO THE SCENE OF THE CRIME to harass mourners during a peaceful candlelight vigil for Garrett.
-On the night in question, PERRY INSTIGATED THE VIOLENCE by driving his car directly into the protest march, with a clear intent to disrupt and harm the protest and its people.  There is no conceivable way to justify this act.
>Despite the claim in his statement, many protesters had already entered the intersection at 4th and Congress before Perry decided to attack the protest. There is no way that he could’ve confused what was going on, and to claim otherwise is dangerous.
>It is clear from the police dashcam video that Perry aggressively accelerated into the crowd, and that aggression was furthered by his conscious, evil decision to murder Garrett Foster, unprovoked.
>IF PERRY WAS UNAWARE OF THE PROTESTERS, WHY DID HE WAIT FOR HIS LIGHT TO TURN
RED BEFORE DRIVING INTO THE PROTESTERS, AS CLEARLY SHOWN IN THE POLICE DASHCAM VIDEO? THE ONLY EXPLANATION IS THAT IT WAS DECISIVE AND INTENTIONAL.
-The statement made by Daniel Scott Perry and his lawyers portrays the protesters as “beating” the vehicle, which is a blatant
mischaracterization. Protesters surrounded the vehicle in order to figure out the identity of the driver. Perry always had a clear lane to leave.
-Garrett kept his rifle in a ready position at all times. Any implication that Garrett deserved to be killed for carrying his rifle
to protect Whitney is disgusting and patently false.
-Garrett in no way represented himself as law enforcement, or attempted in any other way to misrepresent himself. His attire could not be possibly confused as a police uniform.
-Based on eyewitness accounts, Perry lowered his
window without command and fully extended his arm out of the window before firing.
-PERRY QUICKLY FLED THE SCENE, despite the characterization in his statement. His cooperation with the police is merely an effort to make himself the victim, when HE IS IN ACTUALITY A CRIMINAL,
AND HE KNOWS IT-. By engaging with Daniel Scott Perry in this subdued, almost friendly way, the Austin Police Department has fully shown its hand and chosen the side of murderous white supremacy over moral, righteous people seeking equality and justice.
TLDR:
-GARRETT FOSTER IS A HERO who demonstrated his unassailable character everyday of his life. Garrett was a loving, kind, courageous soldier in the fight for justice and equality. He died heroically, and any attempt to drag his name through the mud is disgusting.
We will not tolerate this, nor any destruction/vandalization of his memorial site.

-PERRY IS NOT THE VICTIM. He repeatedly made threats to the protesters, commented on the President’s tweets with specific, detailed instructions on how and where to shoot protestors,
then he went through with them. His actions were nothing short of premeditated and evil. Daniel Scott Perry is a MURDERER and his release by APD proves their willingness to support and perpetuate white supremacist terrorism.

We call on the AUSTIN POLICE DEPARTMENT and
Travis County District Attorney MARGARET MOORE to file charges against DANIEL SCOTT PERRY for the 1ST DEGREE MURDER of GARRETT FOSTER. It is time for Law Enforcement and the District Attorney to step up and pursue justice for this abominable crime. We Demand Justice For Garrett!
