And my favorite part was that the argument for dismissal was based on the idea that he was just "passively repeating" old denials.

The judge literally referenced Dershowitz's appreciation for "Chutzpah" in the opinion."

If you are arguing that your statements were repeated only passively, do not write that you have made "efforts."
And then, Dershowitz argues that he's only acting in self-defense, which... look at the test for that:
The phrase "common sense" should only ever appear in legal writing in sarcastic scare quotes, as it does here.
Followed immediately by "unfairness" also in scare quotes.
In short, Alan Dershowitz is an absolute nightmare client, and I cannot imagine him being competent counsel for anyone, ever, at any time.
