What does the Transgender Persons (Protection of Rights) Rules, 2020 say?

1. It Specifies the process through which transgender persons can apply for a Certificate of Identity and the manner in which such certificate will be issued.
2. Under Section 6, the Application process requires a transgender person to submit the application form, an affidavit and a psychologist’s report (where in the psychologist is of a hospital of “appropriate Government”).
3. The applicant requires to reside in the area of the District Magistrate for a continuous period of an year to apply under the DM.

4. Certificate of Identity shall be issued within 60 days of application. An identity card shall also be issued by the DM.
5. The Certificate of Identity shall ensure changing of names in all official documents as well as the gender with accordance to the identity card. The authority shall change the name/gender on the said official document within 15 days of the application. Revised official doc.

6. Issue of the certificate and the identity card shall be included in the Right to Public Services Act.
7. Under Section 7, the transgender person having undergone sex-change surgery can apply by enclosing with the application form a medical certificate by the Medical Superintendent or Chief Medical Officer of the medical facility in which the surgery has taken place.
8. If an application for Certificate of Identity is rejected, the applicant may appeal the decision within 30 days from the date of rejection. Appeals will be directed to the appellate authority designated by the appropriate government.
9. If an application for Certificate of Identity is made with an intention to falsely obtain the status of transgender, the applicant may face penalties.
10. The appropriate government must: (i) review existing welfare measures and schemes to include transgender persons, (ii) ensure welfare schemes, programmes and subordinate legislation are non-discriminatory towards transgender persons,
(iii) take adequate steps to prohibit discrimination towards transgender persons, and (iv) educate transgender persons on benefits available to them.
11. The appropriate government must create facilities, such as rehabilitation centres, HIV surveillance centres, separate hospital wards and separate wash rooms in establishments for transgender persons within two years from notification of rules.
12. The National Institute of Social Defence, under the Ministry of Social Justice and Empowerment, will act as the secretariat to the National Council for Transgender Persons. The central government will provide grant-in-aid to the NISD for providing this function.
