There is no FIR registered by the Mumbai Police.

What's this huge media coverage of so many people going to Bandra Police station for interrogation?
Okay, they are being questioned under sections of Criminal Procedure Code (CrPC).
The jurisdiction under CrPC remains solely with the police.
Mumbai Police were conducting investigations under sections of CrPC while Patna Police has registered an FIR.
What's the difference?
There is a BIG difference & we should know about it.
Technically the FIR might take this case away from Mumbai Police leaving them with few choices
First Information Report or FIR is usually filed when there is a complaint received or enough prima facie evidence for a case to be tried in the Court of law.
Investigations under CrPC continue when there is no adequate prima facie evidence for a lodging a criminal case
Investigations under CrPC is done to collect evidence which MAY or MAY NOT lead to an FIR.
If enough evidence isn't available, FIR is not lodged.
FIR means that the case which must go the Court and then the Court will decide who's guilty or not.
The main difference: Jurisdiction.
In case of an FIR, the police needs to submit their investigations to the Court.
But under CrPC, the jurisdiction remains with the police and usually no court interferes because the matter doesn't come under their jurisdiction.
In case of an FIR, a chargesheet has to be submitted
If an accused is arrested then chargesheet must be filed in 60 days (90 days for major crimes).
In CrPC, there are no such rules.
Basically, Mumbai Police had the option to close this case after investigations if evidences weren't enough.
Now, this case has gone to a Patna court.
Now, Mumbai Police have very limited options.
1. Continue investigations under CrPC
or
2. Lodge an FIR with all available evidence.
In the absence of an FIR, this case will entirely shift out of Mumbai to Bihar as FIR has been lodged in Patna.
This case will go out of their hands
This might be good or bad as you see it.
Good: No political pressures. The case goes to Patna & Mumbai Police cooperates with Patna Police.
Bad: Patna Police SIT will take over & Mumbai Police will play a supporting role.
So Mumbai Police will have to make an informed choice soon
Doesn't matter how you see it.
The investigation will gather pace.
While there is immense pressure from Bihar as Sushant was their son of the soil, Bollywood Wokes here are constantly trying to divert your attention or mislead you.
Hope justice will be served sooner.
