BREAKING / thread: Trump & DHS are now in open defiance of the Supreme Court and several federal courts. 2/ #SCOTUS gave Trump a clear roadmap. Everyone agrees he can end #DACA / modify, but he needs to go through a legal process that SCOTUS outlined. He refuses. Instead he issues a memo saying he's "considering" what to do about DACA and in the meantime defying the federal courts.
3/ This is blatantly unlawful, from the same @DHSgov whose goons are in the streets beating and arresting peaceful protesters in the name of "law and order."
4/ The administration says it will do the following: REJECT new #DACA apps. Process renewals, but grant only one-year extensions. REJECT advance parole apps absent "exceptional circumstances." Again, this is unlawful, open defiance of clear federal court orders.
5/ Don't give up. FILE your initial #DACA ASAP. He's clearly going to rescind or partially rescind the program soon. If you file before that happens, you will be in a good position to sue or benefit from federal litigation if your app is unlawfully rejected / denied.
6/ Don't give up. FILE your #AdvanceParole requests ASAP if you want to travel. If it's unlawfully rejected or denied, you'll be in a better position to sue or benefit from federal litigation. But when Trump rescinds the program that opportunity will likely be gone.
7/ And of course, call your senators / reps. They represent YOU even if you aren't a citizen. Tell them to pass the #DREAMAct now so that you don't have to depend on the whims of an administration that has no respect for your life and the rule of law.
8/ A federal court already ordered a high-level DHS official to come back to court this Friday to explain what on earth is going on and why the admin isn't openly accepting new #DACA apps. Expect to see him/her raked over the coals, and possible contempt of court proceedings.
9/ I'm seeing a lot of smart lawyers/reporters incorrectly stating that today's #DACA memo is the new attempt to rescind/modify DACA, allowed by SCOTUS. That's NOT what it is. They say they are still considering making changes to #DACA, and this is their interim plan.
10/ That's why today's #DACA memo is illegal. SCOTUS & federal courts said "until and unless you issue a new memo modifying / rescinding DACA properly, you must reinstate the program as it existed until 9/2017." They cannot have it both ways.
