Some notes: smell of weed not being probable cause exempting you from searches of your PERSON has been a thing (in MD) for upwards of two years. The new point of info states smell of weed is less probable cause for car searches than it used to be on top of definitively showing across the board COPS IN MD CANNOT SEARCH YOUR PERSON EVEN IF YOU’RE IN A CAR WITH THE SMELL OF WEED. Car searches’ll take legal pushback
Could a cop take your fidgeting in your pockets as probable cause of concealing something and try to strong arm you into accepting a search of your person to “calm them down” then say you accepted in court? Yes. They’ll always have work arounds. Don’t agree to search of yourself
Car searches from this court document seem like if they’re made they can be argued by good legal defense in your favor. Legal defense telling you anything found on your person can be used to charge you needs to be abandoned. Anything found in your car could be expunged. Depends
Best note: I’m definitely NOT saying you should hide stuff on your person if you are trying to hide anything in your car from the feds but if you’re in your car in any capacity, cops can still use the smell to search your car. They try to search you later? NAH. Fight in court
