He would have had to show the British state was unable or unwilling to protect him from persecution. As a matter of law no EU state would accept that were the case about the UK.

Spain has introduced a declaratory settled status system for the many British immigrants who call that country home: they are automatically granted permanent residence and can register for their paperwork as and when needed.
This is far better than the UK approach because....

There is no arbitrary deadline beyond-which anybody who has failed to apply to secure their status suddenly becomes undocumented over night.
