THREAD - Roll back of liability protections for NY hospitals, nursing homes, and physicians during #COVID will have dangerous unintended consequences
It will handicap our healthcare system’s ability to handle any future surges

When #COVID was hitting NYS hard in March and April, NY hospitals, nursing homes, and doctors had to make tough decisions FAST about redistributing healthcare resources
Hospital bed capacity rapidly increased
Elective surgeries stopped
Outpatient clinics cancelled

The surge was fast approaching. Tens of pts dying a day were quickly turning into hundreds a day
Everyone had to make tough decisions to try to save lives
All through the fog of covid, not understanding how exactly this virus spread with critics saying NYS was overreacting

Think about the last time you went to a clinic or hospital and the amount of paperwork you had to sign
Stacks right?
Why all that paperwork? NYS is unfortunately a tough state to practice in. Docs are more likely to get sued. The payouts are huge..

Now imagine #COVID bearing down on your hospital and having to make incredibly tough decisions about who gets a ventilator and who doesn’t
Or calling your patient to tell them their breast mass biopsy delayed due to COVID
And then wondering: will I get sued for this?

The intent of @NYGovCuomo executive order was to eliminate all barriers to mounting a successful response to #COVID
To allow hospitals, nursing homes, medical staff to focus on singularly most important goal at the time: prevent overwhelming of our HC system
We succeeded

I understand the intent of this law: giving non-covid patients avenue for legal recourse if they were affected adversely
But we need to be cautious of disabling ability of our HC system to respond to future #COVID surges

And maybe it’s not the intent of this law, but telling us now after the fact that “actually, you may get sued for cancelling that elective surgery because you were told to” is truly a slap in the face to doctors all around
HC heroes?
Just another win for trial lawyers
