The overall number of prosecutions of female #returnees from ISIL remains low. But there are some important trends which reveal a range of gender-specific challenges in investigations, types of charges, sentencing practices and rehabilitation & reintegration programmes
Gender #bias can cut both ways: it can infantilize women or vilify their support for terrorism. This can lead to some women never being prosecuted, while others receive disproportionately harsh sentences
Women have been prosecuted for crimes against their own #children whom they brought to #ISIL. Our data didn’t show any cases of men being held accountable for such crimes as #fathers
#Rehabilitation & #reintegration programmes, in & outside the criminal justice system, often don’t consider women’s rights & needs. There needs to be systematic M&E of the gender & #HumanRights impact of such programmes
More attention should be paid to #Iraqi and #Syrian women associated with ISIL and the specific challenges relating to their #rehabilitation and #reintegration into their #communities
We need tailored, case-by-case & #gender-sensitive criminal justice approaches which take seriously the different roles that women can play in terrorist groups, including any violent roles, as well as take into account any mitigating circumstances
For this to happen, there is an urgent need for training and capacity building in the criminal justice system on gender-sensitive approaches to #investigations and #prosecutions
