What this is setting up is for the White House to issue bogus apportionment numbers to Congress. There is no process in place to identify a person’s citizenship status for the apportionment (a supplemental citizenship tabulation is due mid-2021 for redistricting data)

I'll focus on this particular passage of the Executive Order. The Census Bureau has five months to devise and implement a methodology to make a citizenship correction to the apportionment numbers. I do not think that is possible. You can't just do this on the back of an envelope

But, as I think about this more, the courts may defer on taking action until the December apportionment counts are released. Until then it is impossible to know what effect, if any, the Executive Order has. If Census reports they can't figure out how to do this, a case is moot
That doesn't mean plaintiffs won't be able to file a lawsuit, engage in discovery, and interview Trump administration officials in depositions.
There are so many pieces to this legal puzzle it is hard to game them all out:

- Can Census come up with a reliable adjustment in 5 months?
- Will the courts allow it?
- Will (the new) Congress accept the numbers?
- Would a new administration reverse course?
