Today we deal with #Post EC #Monitoring.

All #Prior #Environment #Clearance (EC) letters to projects carry #Conditions that a #Project #Proponent (PP) is required to fulfill during
a) Construction phase
b) Operation phase
&
c) Post operation phase (especially in cases of mining projects)

It is extremely important that these conditions are not only available in public domain but that public is actively involved in the #Monitoring thereof.

#EIA2006 and #DraftEIA2020 provide that
In respect of Category ‘A’ project, it shall be mandatory for the #PP to make public the #EC granted for their project along with d conditions and safeguards at their cost by prominently advertising it at least in two local newspapers of d district or State where d project+
is located and in addition, this shall also be displayed in d project proponent’s ( #PP) website permanently.
In respect of Category ‘B’ projects, d #PP shall prominently advertise in d newspapers indicating that d project has been accorded environment clearance & d details of+
the MoEF website where it is displayed.
The Ministry of Environment and Forests and d State/Union Territory Level Environmental Impact Assessment Authorities (SEIAAs), as d case may be, shall also place d #EC in the public domain on Governmental portal.
The copies of the #EC +
environmental clearance shall be submitted by d #PP to the Heads of local bodies, Panchayats & Municipal Bodies in addition to d relevant offices of the Government who in turn has to display the same for 30 days from d date of receipt.”;
It shall be mandatory for d #PP+
project management to submit half-yearly compliance reports in respect of d stipulated prior #EC terms & conditions in hard & soft copies to d regulatory authority concerned, on 1st June & 1st December of each calendar year.
All such compliance reports submitted by d #PP+
project management shall be public documents. Copies of d same shall be given to any person on application to d concerned regulatory authority. The latest such compliance report shall also be displayed on the web site of d concerned regulatory authority.
Regional offices of+
#MoEFCC and state Pollution Control agencies shall monitor d compliance of the #Prior #EC conditions.
In a welcome move d #draftEIA2020 provides for #EC conditions to b monitored by reputed govt institutions of national repute as under:
"To supplement d efforts of d @moefcc for+
+monitoring through Regional office of d Ministry, Regional Directorate of CPCB, SPCB d Ministry may empanel government institutions of national
repute for carrying out compliance monitoring of conditions of prior-EC or prior-EP,
as d case may b of projects in a random manner"
It is equally important that members of public & non govt civil society groups/NGOs are also invited to #Monitor d terms & conditions of #Prior #EC and report d same to the #Regulatory #Authorities from time to time.
This is essential since often d #PP bother little to implement+
the terms & conditions of #Prior #EC and resultantly ppl r left to either suffer d pollution of air, land and water in their locality or approach d Courts for relief.
This situation is unacceptable & hence members of public must b mandated by law to #Monitor d #EC conditions.
